Terms and Conditions for Gardeners Whetstone
These Terms and Conditions set out the basis on which Gardeners Whetstone provides gardening and grounds maintenance services to domestic and commercial clients. By making a booking, the customer agrees to be bound by these terms. They are intended to create a clear, fair and practical framework for the supply of services, including the booking process, payment terms, cancellations, liability limits, waste handling, and the law that applies to the agreement.
For the avoidance of doubt, these terms apply to all routine and one-off work carried out by the gardening service, whether the task involves lawn care, hedge trimming, planting, pruning, clearance, seasonal tidy-ups, or related maintenance. If any part of an estimate, quotation, or written confirmation differs from these terms, the specific written agreement will take priority only for that individual booking and only to the extent of the inconsistency.
These terms are written in plain language to help customers understand what is expected on both sides. They do not replace any legal rights that a customer may have under UK consumer law, and nothing in them is intended to exclude or restrict those rights unlawfully.
The booking process for Gardeners Whetstone services begins when a customer requests a quotation, assessment, or agreed scope of work. Any price provided before the work starts is based on the information available at that time, including the size of the area, the condition of the site, access, expected labour, and any equipment or materials that may be needed. If the customer supplies incomplete or inaccurate information, the estimate may need to be revised before work begins.
A booking is only confirmed when the service provider accepts the request and the customer accepts the quotation or proposed appointment. Confirmation may be given verbally or in writing, including by email or message. In some cases, a deposit or advance payment may be required to secure a date, especially where specialist equipment, materials, or scheduled labour are being reserved. Until confirmation is issued, no date should be treated as fixed.
Customers should ensure that the site is accessible and reasonably ready for work on the agreed date. This includes providing any relevant instructions, permissions, parking arrangements where applicable, and notice of hazards such as unsecured animals, unstable structures, hidden utilities, or restricted access. If access problems prevent the work from starting or being completed, Gardeners Whetstone may charge a reasonable waiting fee, abortive visit fee, or additional attendance charge where appropriate.
Payments are due in accordance with the quotation, invoice, or written confirmation provided for the booking. Unless otherwise stated, invoices are payable immediately upon completion of the work or within the stated payment period. Accepted payment methods may include bank transfer, card payment, cash, or another method agreed in advance. Any method not expressly agreed should not be assumed to be available.
Prices are normally quoted in pounds sterling and may be exclusive or inclusive of VAT depending on the trading status of the service provider. Where VAT is chargeable, it will be shown where required by law. If additional work becomes necessary during the visit, the customer will normally be informed before that work proceeds, and the price may be adjusted to reflect the extra time, materials, plant hire, waste handling, or specialist expertise involved.
Late payment may result in the suspension of further services until the account is settled. Gardeners Whetstone may also reserve the right to charge reasonable interest or recovery costs on overdue sums where permitted by law. Any dispute about an invoice should be raised promptly and in good faith. Undisputed amounts remain payable even where another element of the invoice is questioned.
Cancellations and rescheduling should be made as early as possible. Because gardening appointments are often scheduled around weather, equipment, and labour availability, late changes can cause avoidable loss. If a customer cancels within a short period before the planned visit, or fails to provide access on the day, a cancellation fee may apply to cover reserved time and preparatory costs. The amount of any fee will be reasonable and proportionate to the loss caused.
Where a cancellation is made by the service provider, every reasonable effort will be made to offer a new appointment at the earliest suitable time. If a booking must be changed due to severe weather, health and safety concerns, equipment failure, staffing issues, or events outside reasonable control, the work may be postponed without liability for any indirect loss. Any deposit already paid will normally be carried forward to the rescheduled visit unless the parties agree otherwise.
If the customer wishes to reduce the scope of work after booking, the price may be adjusted to reflect the revised instructions, provided the change is agreed before the work is carried out. If the work has already started, the customer may still be responsible for the labour and materials already used up to the point of the change.
Liability is limited to the direct loss or damage caused by proven negligence, breach of contract, or failure to exercise reasonable care and skill. Gardeners Whetstone will not be responsible for losses that are indirect, consequential, or beyond reasonable control, including loss of profit, loss of opportunity, or pre-existing defects that were not caused by the service. Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot lawfully be excluded.
The customer remains responsible for disclosing known hazards and for protecting items that are fragile, valuable, or easily damaged. Gardening work can involve cutting, digging, lifting, use of powered tools, and movement of plant material, and reasonable care will be taken to avoid damage. However, natural wear, hidden decay, buried objects, weak fencing, unstable paving, and similar pre-existing conditions can sometimes lead to unexpected issues. Gardeners Whetstone will not be liable for damage arising from such conditions where they were not reasonably foreseeable.
Where a claim for damage is made, the customer should notify the service provider as soon as reasonably possible and provide reasonable evidence of the issue. The service provider may inspect the site or request supporting information before accepting responsibility. If liability is established, any remedy will usually be limited to repair, replacement, or the reasonable cost of rectifying the affected work, at the service provider’s discretion and in line with legal requirements.
Waste handling and disposal are an important part of gardening work and must be managed in accordance with UK waste regulations. Green waste, soil, branches, clippings, and related debris may be removed from the site only where this has been included in the quotation or agreed in advance. Any waste that is taken away will be handled responsibly and sent to appropriate recycling, composting, or disposal facilities where possible.
The customer should be aware that waste produced during the service remains the customer’s responsibility unless the service provider has expressly agreed to remove it. If the customer asks for waste to be bagged, stacked, or left in a particular place, this should be agreed before work starts. Gardeners Whetstone may refuse to remove waste that is hazardous, contaminated, unlawful to transport without special arrangements, or likely to breach environmental rules.
Where waste transfer documentation, duty of care records, or proof of lawful disposal is required, it may be provided or retained in line with applicable regulations. The customer must not ask the service provider to dispose of restricted materials in a way that would breach the law. If the site contains unknown substances, sharp objects, asbestos-related material, fly-tipped waste, chemicals, or other potentially hazardous items, the work may be paused until the issue has been assessed and an agreed approach has been reached.
All work is carried out on the understanding that plants, lawns, shrubs, trees, and soil conditions can be affected by season, weather, disease, pests, or pre-existing neglect. Because of these natural variables, no guarantee can be given that every plant will thrive or that a garden will achieve a specific aesthetic outcome immediately after completion. Any advice given is provided in good faith, but the customer remains responsible for deciding whether to act on recommendations.
Gardeners Whetstone may use subcontractors, assistants, or third-party suppliers where necessary to deliver the service efficiently. Any such persons will be expected to work to appropriate standards, but the service provider may still rely on equipment supplied by others, subject to normal checks and reasonable care. If a customer requests a particular product, treatment, or method that is unsuitable for the site, the service provider may decline to use it or may offer an alternative approach.
In addition, the customer agrees not to obstruct the work or interfere with safe working practices. Children, pets, and visitors should be kept away from active work areas, sharp tools, trip hazards, open gates, and machinery. If the service provider believes a task cannot be completed safely, the work may be stopped or limited until the risk has been reduced. Any resulting delay or extra time may be charged where it is reasonable to do so.
Termination of a booking may occur if either party materially breaches these terms, if payment is not made when due, if access is repeatedly denied, or if it becomes unsafe or unlawful to continue. In such cases, any sums due for work already completed, materials supplied, or costs reasonably incurred will remain payable. Termination does not affect rights or liabilities that have already arisen before the termination date.
Personal data supplied during the booking process will be used only for arranging, delivering, invoicing, and administrating the service, and may also be kept for record-keeping and legal compliance. Information will be handled in accordance with applicable data protection law. It will not be sold or disclosed to unrelated third parties except where needed to perform the service, meet legal obligations, or enforce rights under these terms.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force so far as legally possible. A failure to enforce any right on one occasion will not prevent that right from being enforced later. These terms may be updated from time to time, but the version in force at the time of booking will normally apply to that booking unless a change is required by law.
These terms and any dispute or claim arising from them shall be governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute unless consumer law requires otherwise. By proceeding with a booking, the customer confirms that they have read, understood, and agreed to these service terms for Gardeners Whetstone, including the arrangements for payment, cancellation, liability, waste management, and lawful performance of the work.
